CEC in the News: Election integrity groups press Supreme Court to require ballots by Election Day

Fox News reports “FIRST ON FOX” on the latest efforts at the Supreme Court to protect Election Day by Center for Election Confidence (CEC), Honest Elections Project (HEP), Restoring Integrity and Trust in Elections (RITE), and American Legislative Exchange Council (ALEC).

The conservative-leaning groups, including the Honest Elections Project and the Center for Election Confidence, filed an amicus brief on Tuesday supporting the Republican National Committee’s challenge to Mississippi’s postmark deadline.

Today’s amicus brief before the Supreme Court in Watson v. RNC (No. 24-1260) is CEC’s second brief in this important case and addresses the merits of the case. CEC filed its first brief in partnership with HEP and RITE to urge the Supreme Court to hear the case and affirm the Fifth Circuit’s decision below.

[CEC and its partners] argue that federal law establishing a single Election Day requires ballots to be in election officials’ hands by the close of polls.

As Fox News notes, CEC and its partners argue that “allowing ballots to arrive after Election Day can lead to delayed results and can chip away at voters’ confidence in elections.” The article also highlights CEC’s important, recent work with respect to the U.S. Postal Service’s changes to postmarking rules, noting that “postmarks might not reliably reflect when a ballot entered the mail.”

“Congress has spoken, and federal law is clear: Election Day means Election Day. It is vital for voters’ confidence that this bright line rule is applied evenly in all federal elections for mail ballot return and receipt. Stretching elections beyond Election Day not only violates federal law, but also sows doubt and discord about the tabulation process. CEC urges the Supreme Court to affirm the Fifth Circuit in Watson v. RNC.”
